Alan Baker claims that the Fourth Geneva Convention, which prohibits the forcible deportation or transfer of protected persons by an occupying power, is not applicable in the case of Canada Park because the evicted Palestinian residents were not citizens of any state. This position is in no way supported by the international legal community but is, rather, based on the report of a panel appointed by Benjamin Netanyahu and headed by former Supreme Court justice Edmond Levi. Levi was the single minority justice who ruled against the disengagement from Gaza and is a declared supporter of annexing the West Bank. The conclusions of this obviously biased panel cannot be substituted for the rule of international law. Nor can they justify the expulsion of the Palestinians who lived for generations on the lands of Imwas, Yalo, and Beit Nuba, who buried their ancestors there and who have never been compensated for this immense loss of land, history, and belonging.
